5. Delivery Policy

5.1. Delivery Charges

• Inside Dhaka:

o Free delivery for orders ≥ ৳999

o ৳60 delivery fee for orders below ৳999

o Express Delivery (select areas): ৳60

• Outside Dhaka:

o Free delivery for orders ≥ ৳1500

o ৳ 60 delivery fee for orders below ৳1,499

o Express Delivery unavailable outside Dhaka

5.2. Delivery Time

• Inside Dhaka: 24–48 hours

• Express Delivery: within 4 hours (available in selected areas)

• Outside Dhaka: 3–5 working days

6.1. Account Security

• Users are responsible for maintaining the confidentiality of their login credentials.

8. Intellectual Property Rights

All Platform content, including logos, designs, software, and text, is owned or licensed by Health Pharma. Users are granted a limited, non-transferable license to access and use the Platform for personal, non-commercial purposes. 9. Prohibited Uses

Users must not:

Health Pharma accepts prescription medication orders only upon receipt of a valid prescription from a licensed Bangladeshi healthcare professional. Orders will not be processed without verification of prescription authenticity.

16. E-Consultation Services

Health Pharma offers teleconsultation with registered medical practitioners. These services are for general advice only and not a substitute for physical medical examination. Users must not use this service for emergencies.

17. Order Verification, Returns, and Refunds

Customers must verify orders upon delivery. Refunds or returns are accepted only for defective or incorrect items. Partial returns are not allowed. Refer to our Refund Policy for details.

৩. পরিষেবা প্রদানের ধরন

৩.১। Health Pharma একটি লাইসেন্সপ্রাপ্ত অনলাইন ফার্মেসি ও হেলথ-টেক প্ল্যাটফর্ম; পণ্য সরবরাহকারী হিসেবে ভেরিফাইড ম্যানুফ্যাকচারার, আমদানিকারী, ও ডিস্ট্রিবিউটরের মাধ্যমে ওষুধ, স্বাস্থ্যপণ্য, ল্যাব টেস্ট, পার্সোনাল কেয়ার, বেবি কেয়ার, সাপ্লিমেন্ট ইত্যাদি সরবরাহ করা হয়।

৩.২। আমাদের কার্যক্রম নিবন্ধিত ও যোগ্য ফার্মাসিস্টদের তত্ত্বাবধানে পরিচালিত হয়, এবং DGDA ও প্রযোজ্য নিয়মাবলীর সাথে সঙ্গতিপূর্ণ।

৪. গোপনীয়তা নীতি (Privacy Policy)

৪.১। আপনার ব্যক্তিগত তথ্যের গোপনীয়তা আমাদের অগ্রাধিকার। বিস্তারিত নীতির জন্য আমাদের Privacy Policy দেখুন—তাতে তথ্য সংগ্রহ, ব্যবহার, সংরক্ষণ ও শেয়ারের পদ্ধতি স্পষ্টভাবে বর্ণিত আছে।

৫. ডেলিভারি নীতি

৫.১ ডেলিভারি চার্জ

• ঢাকা শহরের মধ্যে: অর্ডার ≥ ৳৯৯৯ হলে ডেলিভারি ফ্রি;

• অর্ডার < ৳৯৯৯ হলে চার্জ ৳৬০;

• এক্সপ্রেস (নির্দিষ্ট এলাকায়) ৳৬০।

• ঢাক বাহিরে অর্ডার ≥ ৳১,৪৯৯ হলে ডেলিভারি ফ্রি; নয়তো চার্জ ৳১২০;

• এক্সপ্রেস সেবা প্রযোজ্য নয়।

৫.২ ডেলিভারির সময়

• ঢাকা: ২৪–৪৮ ঘণ্টা (স্ট্যান্ডার্ড)

• এক্সপ্রেস: নির্ধারিত এলাকায় স্বল্প সময়ে (প্রায় ৪ ঘণ্টা)

• বাইরের জেলা: ৩–৫ কার্যদিবস

(অপ্রত্যাশিত পরিস্থিতিতে সময়সীমা পরিবর্তিত হতে পারে।)

৬. ব্যবহারকারীর দায়িত্ব

৬.১। অ্যাকাউন্ট ও পাসওয়ার্ডের গোপনীয়তা রক্ষা করা আপনার দায়িত্ব।

৬.২। আপনার অ্যাকাউন্ট থেকে সংগঠিত যেকোনো কার্যকলাপের দায়বোধ আপনাকেই বহন করতে হবে। সন্দেহভাজন অননুমোদিত প্রবেশ তথ্য পেলে সঙ্গে সঙ্গে আমাদের জানাবেন।

৭. তৃতীয় পক্ষ প্রচারণা ও অফার

৭.১। প্ল্যাটফর্মে তৃতীয় পক্ষের বিজ্ঞাপন বা অফার থাকতে পারে; Health Pharma সেই সমস্ত অফার বা পণ্যের গুণমান/উপযুক্ততার নিশ্চয়তা দেয় না—আপনার দায়িত্ব সেগুলি যাচাই করা।

৮. মেধাস্বত্ব (Intellectual Property)

৮.১। প্ল্যাটফর্মের সমস্ত কনটেন্ট, লোগো, সফটওয়্যার ইত্যাদি Health Pharma-এর সম্পত্তি বা লাইসেন্সকৃত। অনুমতি ছাড়া পুনর্বিতরণ, অনুলিপি বা ডেরিভেটিভ কাজ তৈরি করা যাবে না।

৯. নিষিদ্ধ কার্যক্রম

৯.১। প্ল্যাটফর্মকে কোন অবৈধ উদ্দেশ্যে ব্যবহার করা যাবে না; সিস্টেমে অননুমোদিত প্রবেশ, ম্যালওয়্যার আপলোড ইত্যাদি কঠোরভাবে নিষিদ্ধ।

১০. শর্ত লঙ্ঘনের পরিণতি

১০.১। শর্ত লঙ্ঘন করলে অ্যাকাউন্ট স্থগিত বা বাতিল, আইনি ব্যবস্থা বা ক্ষতিপূরণ দাবি করা হতে পারে। Health Pharma তার সুরক্ষার জন্য প্রয়োজনীয় আইনগত পদক্ষেপ গ্রহণের অধিকার সংরক্ষণ করে।

১১. সার্ভিস ও কন্টেন্ট সীমাবদ্ধতা

১১.১। আমরা সর্বোত্তম চেষ্টা করি তবে প্ল্যাটফর্মের নিরবিচ্ছিন্নতা বা ত্রুটিহীন কার্য সম্পাদনের গ্যারান্টি দেয়া সম্ভব নয়। প্ল্যাটফর্ম যে কোনো সময় পরিবর্তন, স্থগিত বা বন্ধ করার অধিকার রাখে।

১২. বহিরাগত লিঙ্ক

১২.১। সাইতে কখনো তৃতীয় পক্ষের ওয়েবসাইটের লিঙ্ক থাকা সম্ভব; সেগুলোর বিষয়বস্তু বা গোপনীয়তা নীতি সম্পর্কে Health Pharma দায়ী নয়।

১৫.১। আমরা উপযুক্ত নিরাপত্তা ব্যবস্থা গ্রহণ করি, কিন্তু ইন্টারনেট ট্রান্সমিশনের স্বভাবগত সীমাবদ্ধতার কারণে সম্পূর্ণ নিরাপত্তা নিশ্চিত করা যায় না; ব্যবহারকারীরা তথ্য প্রেরণ নিজের ঝুঁকিতে করবেন।

১৮. প্রেসক্রিপশন সম্পর্কিত পরিষেবা

১৮.১। প্রেসক্রিপশন ওষুধ শুধুমাত্র বৈধ, লাইসেন্সপ্রাপ্ত বাংলাদেশি চিকিৎসক কর্তৃক ইস্যুকৃত প্রেসক্রিপশনের ভিত্তিতে প্রদান করা হবে। প্রেসক্রিপশন যাচাই ও ভেরিফিকেশন করা হবে; অনুপস্থিতি বা অনিশ্চয়তা থাকলে অর্ডার বাতিল হতে পারে। প্রেসক্রিপশন ভিত্তিক বিতরণে ডেলিভারি গ্রহণের সময় স্বাক্ষর প্রয়োজন হতে পারে।

১৯. ই-কনসালটেশন (Teleconsultation)

১৯.১। Health Pharma নিবন্ধিত চিকিৎসকের সাথে ই-কনসালটেশন সুবিধা প্রদান করে—এটি সাধারণ পরামর্শের জন্য; জরুরি সেবার বিকল্প নয়। Health Pharma কেবল মধ্যস্থতাকারী; চিকিৎসার ফলাফলের জন্য দায়শীল নয়।

২০. সাবস্ক্রিপশন পরিষেবা

২০.১। ব্যবহারকারীরা পুনরাবৃত্তি ভিত্তিক ওষুধ সরবরাহের জন্য সাবস্ক্রাইব করতে পারবেন; সাবস্ক্রিপশনের শর্ত ও প্রাপ্যতা প্রযোজ্য। প্রচারমূলক অফারসমূহ সবসময় সাবস্ক্রিপশনে প্রযোজ্য নাও হতে পারে।

২১. অর্ডার সম্পাদন ও মূল্য নির্ধারণ

২১.১। সাইটে দেখানো মূল্যগুলো আনুমানিক; চূড়ান্ত মূল্য ইনভয়েসে প্রতিফলিত হবে। মূল্য পার্থক্যের ক্ষেত্রে অতিরিক্ত প্রদান বা ফেরত প্রদানের নিয়ম প্রযোজ্য। রিফান্ড এবং রিটার্ন আমাদের নির্ধারিত নীতির অধীনে সম্পন্ন হবে।

২২. এক্সপ্রেস ডেলিভারি (EDS)

২২.১। নির্দিষ্ট এলাকায় অগ্রাধিকার ডেলিভারি উপলব্ধ; অতিরিক্ত চার্জ প্রযোজ্য এবং সার্ভিস ফি প্রায়ই ফেরতযোগ্য নয়। অর্ডার গ্রহণের পর ডেলিভারি তথ্য পরিবর্তন সীমিত হতে পারে।

২৩. অর্ডার যাচাইকরণ ও রিটার্ন নীতি

২৩.১। ডেলিভারি সময় প্যাকেজ খোলা ও যাচাই করা ব্যবহারকারীর দায়িত্ব। ত্রুটিপূর্ণ বা ভুল পণ্যের ক্ষেত্রে রিটার্ন/রিফান্ড প্রযোজ্য—আংশিক রিটার্ন সাধারণত গ্রহণযোগ্য নয়।

২৪. কনটেন্ট ও পোস্টিং বিধিনিষেধ

২৪.১। ব্যবহারকারীরা এমন কনটেন্ট পোস্ট করতে পারবেন না যা আইনবিরুদ্ধ, মানহানিকর, অশ্লীল বা কপিরাইট লঙ্ঘন করে। Health Pharma অননুমোদিত কনটেন্ট সরানোর অধিকার রাখে এবং ব্যবহারকারী আইনি প্রতিক্রিয়ার সম্মুখীন হতে পারেন।

২৫. অংশীদার ফার্মেসি ও মান সম্মতি

২৫.১। অংশীদার ফার্মেসিগুলো বাংলাদেশের প্রযোজ্য আইন ও নিয়ম মেনে চলতে বাধ্য। Health Pharma কেবল ডিজিটাল প্ল্যাটফর্ম প্রদানকারী; অংশীদারদের নিয়মভঙ্গ বা অযোগ্যতার দায়ভার প্রত্যাহারের অধিকার সংরক্ষণ করে।

২৬. ডাটা সম্মতি ও সরকারি অনুরোধ

২৬.১। Health Pharma প্রযোজ্য আইনের আওতায় ব্যবহারকারীর তথ্য সংগ্রহ, সংরক্ষণ ও ব্যবহার করে; আইনি অনুরোধে প্রয়োজনীয় সংস্থার কাছে তথ্য প্রদান করা হতে পারে।

২৭–২৯. দৈব ঘটনা, সেবা বিঘ্ন ও বিচার বিভাগীয় বিষয়

২৭। দৈবঘটনা (Force Majeure) — প্রাকৃতিক দুর্যোগ, পরিবহন বিঘ্ন, সরকারী বিধিনিষেধ ইত্যাদি কারণে সেবা বিঘ্ন হলে আমরা দায়মুক্ত থাকি; সেবায় বাধা পড়লে আমরা সেবা স্থগিত বা বাতিল করতে পারি।

২৮। সেবা বিঘ্ন বা সাময়িক স্থগিতকরণের ক্ষেত্রে আমরা পূর্বনোটিশ ছাড়াই পদক্ষেপ নিতে পারি।

২৯। এই শর্তাবলী বাংলাদেশ সরকারের আইন দ্বারা শাসিত; বিরোধ নিষ্পত্তির ক্ষেত্রে ঢাকা আদালতই স্বতন্ত্র এখতিয়ারী থাকবে।

৩০. ব্যবহারকারী সম্মতি ও বাতিলের অধিকার

৩০.১। “I have read and accept the terms and conditions” ক্লিক করলে আপনি উপরের সকল শর্তাবলীতে সম্মত হোন।

৩০.২। আপনি চাইলে Health Pharma-কে জানিয়ে আপনার নিবন্ধন বাতিল করতে পারবেন।

৩১. রেফারেল প্রোগ্রাম

৩১.১। রেফারেল পুরস্কার শুধুমাত্র নতুন গ্রাহকদের জন্য যারা তাদের প্রথম অর্ডার সফলভাবে সম্পন্ন করেন। Health Pharma পুরস্কারের অনুমোদন বা প্রয়োজনে প্রোগ্রাম শর্ত পরিবর্তনের অধিকার সংরক্ষণ করে।

৩২. অধিকার সংরক্ষণ ও সংশোধন ক্ষমতা

৩২.১। Health Pharma পূর্বনোটিশ ছাড়াই শর্তাবলী সংশোধন, আপডেট বা পরিবর্তন করার অধিকার রাখে; পরিবর্তিত শর্তাবলী প্রযোজ্য হবে প্রকাশের পর থেকে। আপনার প্ল্যাটফর্ম চালিয়ে যাওয়া নতুন শর্তাবলীর সম্মতিতে গণ্য হবে।
